The Department of Legislative Services has prepared two reports for the legislature on the potential conversion of CareFirst to a for-profit entity. The first report is dated December 1997 while the second report is dated January 2002.  The first report was done as guide for legislators to review the current laws and familiarize them with potential shortcomings in the statute as written at that time.  The second report was undertaken with the knowledge that CareFirst was (or had) filing for conversion.

The first report (December 1997) (click here for the 1997 report) did cause changes in the statute in later years in reference to “burden of proof” or whose duty is it to either prove that conversion is or is not in the best interest of Marylanders. That provision now will be changed (CareFirst agreed not to oppose House Bill 2 (2002) which places the burden of proof on CareFirst). This report will be available soon as it must be converted to electronic format.

The second report (January 2002) is an updated reference for legislators on potential issues and how other states have handled the process. This document is currently availabe here. This is an excellent well written document that contains historical data.
